By accessing or using Plantara ("the Service") at getplantara.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Plantara is operated by the Plantara team, based in Lisbon, Portugal ("we", "us", "our"). These terms form a binding legal agreement between you and us.
Plantara analyses photographs you upload and returns automatically generated information that may include a possible pest species, a confidence score, a severity rating, general health-risk statements, and suggested treatment options. This information is produced in part by artificial intelligence (AI) systems and is provided strictly for general information and educational purposes.
Everything Plantara provides is general informational guidance only. Nothing on the Service constitutes, or is a substitute for, professional advice of any kind, including but not limited to pest-control, extermination, medical, veterinary, agronomic, horticultural, environmental, or legal advice. We and our operators are not licensed exterminators, pest-control operators, doctors, nurses, veterinarians, agronomists, toxicologists, or any other kind of licensed or certified professional. No content, output, communication, or interaction with the Service creates any professional, advisory, diagnostic, or fiduciary relationship between you and us. You should not act, or refrain from acting, on the basis of anything provided by the Service without first obtaining advice from an appropriately qualified and licensed professional.
The Service relies on automated AI image analysis, which is inherently probabilistic and imperfect. Pest identifications, species names, confidence scores, severity ratings, health-risk statements, and treatment suggestions may be wrong, incomplete, outdated, mislabelled, or otherwise unreliable, and may misidentify harmless organisms as dangerous or dangerous organisms as harmless. A high confidence score does not guarantee accuracy. You must independently verify any output before relying on it, and you accept that any reliance you place on the Service is at your sole risk.
Any treatment, pesticide, insecticide, rodenticide, chemical, biological agent, trap, tool, or method referenced by, or applied as a result of, the Service is applied entirely at your own risk. You are solely responsible for selecting, sourcing, handling, applying, storing, and disposing of any such product or method safely and lawfully. Before using any product you must read, understand, and strictly follow the manufacturer's label, instructions, dosage, and safety data sheet, and you must comply with all applicable local, regional, national, and EU laws and regulations governing the purchase and use of pesticides and chemicals. Some products referenced may be restricted, regulated, or prohibited in your jurisdiction.
Pesticides and chemicals can be hazardous to humans, children, pregnant people, the elderly, pets, livestock, wildlife, pollinators, and the environment, and can contaminate food, water, and surfaces. Keep all products away from children, pets, and food preparation areas, wear appropriate protective equipment, ventilate treated areas, and never exceed labelled doses. Misidentifying a pest or misapplying a treatment can cause serious harm. If you are uncertain, stop and consult a licensed pest-control professional. If you, another person, or an animal has been bitten, stung, exposed, poisoned, or is experiencing symptoms, seek immediate medical or veterinary attention or contact your local poison control centre — do not rely on the Service.
You should always consult a suitably licensed professional before taking action based on the Service, and in particular before acting on any health risk, allergic reaction, structural or property damage, food-safety concern, agricultural or crop issue, protected or endangered species concern, or any significant, persistent, or hazardous infestation. The Service is not an emergency service and must not be used in place of emergency, medical, veterinary, or professional pest-control services.
Any professional, exterminator, supplier, product, or service shown in any directory, referral, marketplace, listing, or recommendation within the Service is provided by independent third parties. We do not endorse, vet, certify, recommend, or guarantee any such third party or their products, services, advice, availability, pricing, quality, licensing, or conduct, and we are not a party to any agreement you enter into with them. Any dealings you have with a third party are solely between you and that third party, and we accept no responsibility or liability for them.
You must create an account to access certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate information when creating your account. You must be at least 16 years old to create an account.
You agree not to use the Service for any unlawful purpose, upload images that are offensive or illegal, attempt to reverse engineer or hack the Service, use the Service to spam or harass others, resell or redistribute the Service or its output without written permission, or use automated tools to abuse the Service beyond your plan limits.
Plantara offers free and paid subscription plans. Paid plans are billed monthly through Stripe. By subscribing to a paid plan you authorise us to charge your payment method on a recurring basis. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months. Prices are displayed in Euros and exclude VAT where applicable.
The Plantara name, logo, and all content on the Service are owned by us and protected by copyright and trademark law. By uploading images to Plantara you grant us a limited, non-exclusive licence to process those images for the purpose of providing and improving the Service, including processing by third-party AI providers. You confirm that you have the right to upload any image you submit. We do not claim ownership of your images.
API access is available to Pro plan subscribers only. API keys must be kept confidential. You are responsible for all use of the Service through your API key. We reserve the right to suspend API access for abuse, excessive usage, or violation of these terms.
The Service and all of its output are provided "AS IS" and "AS AVAILABLE", with all faults and without warranty of any kind. To the maximum extent permitted by law, we disclaim all warranties, conditions, and representations, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, reliability, availability, non-infringement, and any warranty that the Service or its output will be uninterrupted, error-free, complete, secure, or correct. We do not warrant that any identification, rating, score, or recommendation is accurate or suitable for your situation.
To the maximum extent permitted by applicable law, Plantara, its operators, owners, employees, contractors, and suppliers shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages of any kind, including without limitation personal injury, illness, death, property or structural damage, infestation, crop, plant, livestock, or pet loss or harm, loss of profits, data, goodwill, or business, and any financial loss, arising out of or relating to your use of, or inability to use, the Service, or your reliance on any output, identification, rating, score, or recommendation, whether based in contract, tort (including negligence), strict liability, or otherwise, and even if we have been advised of the possibility of such damages. Where liability cannot be excluded by law, our total aggregate liability to you for all claims arising from or relating to the Service shall not exceed the greater of the amount you paid us in the 12 months preceding the claim or EUR 50. Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence or for fraud.
You agree to defend, indemnify, and hold harmless Plantara and its operators, owners, employees, contractors, and suppliers from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your use or misuse of the Service, your reliance on its output, any treatment, product, chemical, or method you apply, your violation of these terms, your violation of any law or regulation, or your infringement of the rights of any third party.
We reserve the right to suspend or terminate your account at any time for violation of these terms. You may delete your account at any time from the Settings page. The disclaimers, warranty exclusions, limitations of liability, and indemnification obligations survive termination.
We may update these terms from time to time. We will notify you of significant changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the new terms.
These terms and any non-contractual obligations arising out of them are governed by the laws of Portugal, without regard to conflict-of-law principles and subject to any mandatory consumer protections of your country of residence within the European Union. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal, save where mandatory law provides otherwise.
If any provision of these terms is found to be invalid or unenforceable, that provision shall be limited or removed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
